THE CERTIFICATE FOR AN INDUSTRIAL DESIGN
An industrial design - is the result of human creativity in the field of artistic design.
In Ukraine, industrial designs, corresponding to such grounds as a novelty, can receive legal protection in the form of a design certificate.
The certificate for an industrial design is issued for a period of 25 years, subject to the payment of an annual fee and the submission of appropriate requests.
The object of the industrial design may be the shape, pattern or color or combination thereof, which define the appearance of industrial products and designed to meet the aesthetic and ergonomic needs.
There are three-dimensional and planar designs. Samples can relate to all items in general (car) or its individual elements (car wheel). You can also patented product is a set of a kit, which includes products that perform different functions, but they are subject to a common purpose that is solved set (set) as a whole. From the point of view of styling products all set (kit) should have community of composition and stylistic solutions, such as tea or dinner service, a set of tools, suite of furniture, etc. .
Volumetric designs is a composition which is based on the volume-spatial structure, for example, art-design decisions that determine the appearance of packaging, bottles, bottle, car, etc.
Planar designs are characterized by linear relation graphic elements, such as art and design decisions that determine the appearance of the label design decorative wallpaper, brochure, carpets, fabrics, etc.
According to the Law on the protection of industrial designs can not get legal protection:
- Objects of architecture (except small architectural forms)
- Industrial, hydraulic and other fixed structures;
- Printed matter as such;
- Objects of unstable form of liquid, gaseous, powdery or similar substances.
To obtain a certificate of Ukraine for an industrial design you must file a patent application, which is made in accordance with "Rules of preparation and submission of applications for industrial design" in the Ukrainian Institute of Industrial Property. The application shall relate to one industrial design and may include its variants (unity). The application is made in the Ukrainian language and should contain:
- Request for the grant of a certificate;
- A set of image products (own products or in the form of its layout, or pattern), giving a complete picture of its appearance;
- A description of the industrial design;
- Drawing, diagram, map (if necessary).
