How to monitor brand use and new trademark applications
After filing or registration, regularly check new signs and how the brand is used in the market. Monitoring helps identify a problem, but does not stop infringement by itself or replace legal analysis.
For tracking new applications, consider ProfitMark trademark monitoring. Select the countries you need and agree the scope of the checks. Application monitoring does not replace separate checks of shops, advertising or domains, and does not automatically stop infringement.
Separate two tasks
In registers, you look for new applications and changes in the status of specific rights. In the market, you check goods, advertising, domains and sellers’ pages. A register match and a suspicious online product require different evidence and next steps.
For international registrations, WIPO offers Find and Monitor tools and Madrid Monitor. These include tracking changes to specific international registrations. Do not treat those notifications as a complete search for every similar brand worldwide.
Set up a simple workflow
- Define the names, spelling variants and logos to monitor.
- Choose the countries, goods, services and sales channels.
- Assign someone to review results.
- Record links, dates, application numbers or seller details.
- Refer significant findings for assessment promptly.
Official details of identified Ukrainian applications can be checked through the official bulletin and SIS search services. Set the review frequency according to business risks and procedural deadlines that may apply to the applications found.
What to do with a finding
For illustration, a customer sends a link to a shop with a similar name. First preserve the page, date, address and product description. Do not rely on a screenshot without context or declare the seller an infringer before checking.
A specialist should compare your rights, territory, goods and actual use. You can then choose an appropriate response. Start with a short team instruction: who receives reports, where evidence is stored and who handles urgent cases.
