How to search for trademarks before filing
Search for trademarks before spending money on a brand launch. Check not only exact name matches but also variants customers might confuse with your sign. Search results help assess risk; they are not permission to use a name or a guarantee of registration.
Prepare the search brief
Write down the name in Ukrainian and Latin script, common abbreviations, possible misspellings and sound variations. Add the logo if it is ready. Separately define the goods, services and countries where you plan to operate. Without these boundaries, even a long list of results offers little help in making a decision.
For example, a hypothetical brand “Лумарі” should be checked not only in that spelling but also in Latin-script variants and similar-sounding words. This illustrates how to build queries; it is not a conclusion that a particular name is available.
Where to search
For a convenient first check of a name, use ProfitMark trademark search. Specify the name, target market and goods or services. This is an initial check: matches and potential conflicts still need a specialist’s assessment.
Official information about Ukrainian applications and registrations is available in the Ukrainian IP Office’s Special Information System.
For international registrations and participating offices’ records, an official source is WIPO’s Global Brand Database. Coverage depends on the source; no single database should be treated as a complete list of rights worldwide.
How to read a result
- Compare the actual sign, not just the result heading.
- Open the goods and services list and compare it with your activities.
- Check the territory, applicant, dates and current status.
- Save the record number, link and date checked.
- Put close matches on a separate list for analysis.
Under Ukraine’s eligibility rules, earlier applications and similarity that may cause confusion in relation to the relevant goods and services also matter. A different class number or a one-letter difference therefore does not resolve the question on its own.
Common mistakes
An available domain, a social media page or no Google results cannot replace a trademark search. Equally, do not dismiss a record simply because the company seems inactive: its legal status and the specific circumstances need assessment.
If you find similar signs, pause expensive packaging work until the risk is assessed. Give a specialist your findings and business description. The practical result should be a decision: keep the name, change it, refine the filing strategy or investigate a particular conflict further.
