When to file: planning your brand protection

Start planning brand protection while choosing a name, before packaging is printed. Filing timing depends on the readiness of the sign, an identified applicant, goods and services, and markets. A practical strategy connects legal checks with the business launch schedule.

Before major spending on the brand

Make a shortlist of names and check them before ordering signs, large product runs and advertising campaigns. The result should be an informed name choice, not just confirmation that a domain is available. If there is a serious conflict, changing the option at this stage is usually organisationally simpler than restructuring a launched business.

Collect information about the future rights holder. The founder, company, designer and marketing agency may have different roles. Ask a specialist to check who should apply and how rights in the graphics are documented. Do not leave this until the day documents are sent.

Once the name is chosen

Agree on the final sign and goods and services list. Checking one version of a name does not clear every later version. If the team changes the spelling or substantially redesigns the logo, send the updated materials for assessment before filing.

The Ukrainian IP Office publishes forms and application preparation requirements. Use current documents. Keep the final application, filing confirmation and payment information where the responsible employee can access them.

Connect protection to market entry

Write down where you already sell, where you are preparing a launch and where you are only testing demand. Set dates and assign responsibility for each territory. A multilingual website, an advertising campaign and regular sales may represent different stages of development; protection decisions should be based on a concrete plan.

International expansion does not necessarily mean filing everywhere at once. However, a phased approach needs to account for deadlines. Under WIPO’s explanation of the Paris Convention, a first regular trademark application can provide a basis for claiming priority in other member states within six months. This right is subject to conditions and does not amount to automatic registration abroad.

For illustration, a manufacturer plans a Ukrainian launch now and its first exports next season. Discuss territories and possible priority shortly after the first filing rather than waiting for Ukrainian registration to finish. Build the precise timetable from the first application’s documents.

After launch

Assign someone to handle correspondence with the office or representative. Create a calendar of key dates and retain incoming documents. The marketing team may miss an official request sent to a former employee’s personal address; keep contact details and access current.

Review the protection portfolio when changing the name, expanding the product range or entering a new territory. Do not treat an old application as confirmation that every new business activity is already covered.

A minimum action plan

Assign a responsible person and expected result to each step: a shortlist of checked names, an approved application or a deadline calendar. Otherwise, a general decision to deal with the trademark can easily remain without anyone to carry it out.

  • Before design and advertising: choose and check the name.
  • Before filing: agree on the applicant, sign, list and territories.
  • After filing: retain documents and set a response calendar.
  • Before exporting: check protection in the new market.
  • As the business grows: review whether rights match actual activities.

Give this plan to the person who controls the budget. Protection costs can then be approved alongside the product launch rather than added at the last moment.

For a convenient first check of a name, use ProfitMark trademark search. Specify the name, target market and goods or services. This is an initial check: matches and potential conflicts still need a specialist’s assessment.
